These Terms and Conditions govern the provision of landscaping services by Handy Landscapers. They outline the expectations, rights, and obligations of both the service provider and the client.
2. Services Provided
Handy Landscapers offers a range of landscaping services, including but not limited to:
- Garden design and maintenance
- Lawn care and mowing
- Planting and pruning
- Hardscaping services such as patios and walkways
- Irrigation system installation and maintenance
All services are subject to availability and are scheduled based on mutual agreement between Handy Landscapers and the client.
3. Booking and Scheduling
To secure a booking, clients must provide necessary information and agree to the proposed schedule. Handy Landscapers will make reasonable efforts to accommodate preferred dates and times, but cannot guarantee availability at all times.
3.1 Confirmation
Upon receiving a booking request, Handy Landscapers will send a confirmation outlining the details of the services to be provided, including dates, times, and costs.
3.2 Changes and Cancellations
Clients wishing to modify or cancel a booking must provide at least 48 hours' notice. Cancellations within 48 hours may incur a fee equivalent to 50% of the scheduled service cost.
4. Payment Terms
Payment for services is due upon completion unless otherwise agreed upon in writing. Handy Landscapers accepts various payment methods, including cash, credit/debit cards, and bank transfers.
4.1 Pricing
All prices are quoted in advance and are subject to change based on the scope of work and any additional requirements identified during service delivery.
4.2 Late Payments
Late payments may incur interest charges at a rate of 2% per month on the outstanding balance until payment is received.
5. Client Responsibilities
Clients are expected to:
- Provide access to the property during scheduled service times
- Ensure the area to be serviced is clear of obstacles and hazards
- Communicate any specific requirements or concerns prior to service commencement
6. Handy Landscapers' Responsibilities
Handy Landscapers commits to:
- Deliver services with reasonable care and skill
- Adhere to agreed schedules
- Use appropriate tools and materials necessary for the services
- Maintain liability insurance to cover any accidental damage during service provision
7. Liability
While Handy Landscapers takes all reasonable precautions, we cannot be held liable for:
- Pre-existing conditions of the property
- Damage resulting from unforeseen circumstances such as extreme weather
- Third-party interventions or actions outside our control
Clients are encouraged to discuss any specific concerns regarding property safety and security prior to service delivery.
8. Guarantees and Warranties
We offer a satisfaction guarantee for our services. If a client is dissatisfied with the work performed, they must notify us within 14 days, and we will address the issue promptly to ensure satisfaction.
9. Privacy Policy
Handy Landscapers is committed to protecting the privacy of our clients. Personal information collected is used solely for the purpose of providing services and will not be shared with third parties without consent, except as required by law.
10. Changes to Terms and Conditions
Handy Landscapers reserves the right to update or modify these Terms and Conditions at any time. Clients will be notified of significant changes, and continued use of our services constitutes acceptance of the updated terms.
11. Dispute Resolution
In the event of a dispute, both parties agree to attempt resolution through mediation before pursuing legal action. This approach aims to resolve conflicts amicably and efficiently.
12. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which Handy Landscapers operates. Any legal actions arising from these terms will be settled in the appropriate courts of that jurisdiction.
13. Severability

These Terms and Conditions constitute the entire agreement between Handy Landscapers and the client regarding the services provided. They supersede all prior discussions, agreements, or understandings, whether oral or written.

By engaging the services of Handy Landscapers, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
15.1 Electronic Acceptance
Clients may accept these terms electronically by proceeding with booking services, which signifies acceptance without the need for a physical signature.
16. Force Majeure
Handy Landscapers is not liable for any delays or failures in service delivery caused by circumstances beyond our reasonable control, including natural disasters, pandemics, acts of government, or other unforeseen events.
17. Indemnification
Clients agree to indemnify and hold harmless Handy Landscapers from any claims, damages, liabilities, and expenses arising from the client's use of our services, except where such claims are due to Handy Landscapers' negligence or willful misconduct.
18. Independent Contractors
Handy Landscapers operates as an independent contractor. Nothing in these terms establishes a partnership, joint venture, or employer-employee relationship between the client and Handy Landscapers.
19. Subcontracting
Handy Landscapers reserves the right to subcontract any portion of the services to third parties, provided that all subcontractors adhere to the same standards and confidentiality obligations outlined in these terms.
20. Feedback and Reviews
Clients are encouraged to provide feedback on the services received. While we value all feedback, Handy Landscapers reserves the right to use client testimonials for promotional purposes, provided personal information is omitted unless explicit consent is given.
21. Warranty Disclaimer
Except as expressly stated in these Terms and Conditions, Handy Landscapers makes no warranties, express or implied, regarding the services provided, including but not limited to fitness for a particular purpose or non-infringement of intellectual property.
22. Data Protection
Handy Landscapers complies with all applicable data protection laws. Clients' personal data is processed fairly and lawfully, and appropriate measures are in place to protect against unauthorized access, alteration, or disclosure.
23. Contract Assignment
Clients may not assign their rights or obligations under these Terms and Conditions to another party without prior written consent from Handy Landscapers.
24. Notices
All notices or communications required or permitted under these terms must be in writing and will be deemed to have been duly given when delivered personally or sent via certified mail to the address provided by the client.
25. Interpretation
In these Terms and Conditions, any references to the singular include the plural and vice versa, and any references to a party include its successors and permitted assigns.
26. Headings
The headings used in these terms are for convenience only and do not affect the interpretation of the provisions.
27. Additional Provisions
Any additional provisions specific to a particular client or project will be outlined in a separate agreement, which will take precedence over these general terms where applicable.

By utilizing the services of Handy Landscapers, clients acknowledge that they have read, understood, and agree to abide by these Terms and Conditions.
